 Terms and Conditions 

  1. Parties: The membership agreement (‘Agreement”) for the type of membership, is between REBOOT Fit Ferreira t/a RE:BOOT Health and Fitness (“The Club”) and the undersigned member (“Member”)
  1. Duration: The agreement is for a month to month contract. Unless the agreement is terminated by the first day of a month for a months’ notice, it shall automatically be renewed on a month-to-month basis. 
  1. Monthly Membership Fees: Unless dues are pre-paid for a period, the monthly billing of this membership will be as follows: 

3.1 The Member shall have access to and usage to The Clubs’ facilities. In exchange for such access and usage, the Member undertakes to pay a monthly membership fee via Debit Order/EFT for a minimum period (the term) as stated in clause 2.

3.2 The membership fee of each month shall be due and payable on the 1st/15th/25th day of each month or the closest business day thereafter. 

3.3 The Member is obliged to pay regardless of whether he/she uses club facilities until the termination date or cancellation date. 

3.4 The membership fee shall be subject to an annual escalation fee, subject to CPI or 7% whichever is greater, regardless of the commencement date of this agreement. The annual escalation fee shall take effect in March of each year that the contract endures. 

3.5 The Club reserves the right to increase membership fees further in its sole discretion, should municipal rates & taxes be increased by local authorities. 

3.6 “EFT Administrators” are hereby authorized to draw/collect from the selected account with the selected bank instruction (or any bank, building society or branch to which the account may be transferred) the instalment amount as indicated on behalf of The Club. The Member agrees to pay any bank charges relating to this payment instruction.

  1. Other charges

 4.1 Initiation Fee and Membership Dues: In consideration of the membership, the Member undertakes to pay a non-refundable registration fee. 

4.2 Payment failure: If the Member fails to pay any amount owing to The Club, including but not limited to any monthly membership subscription or any amount owing to The Club for goods or services supplied by The Club, then The Club shall be entitled to charge a maximum amount of 2% on the default amount plus an administrative fee of R60 per unpaid transaction. The aforementioned shall be in addition to the default amount that is due and payable to The Club. In the event of my membership handed over for collection, the non-discounted monthly rate prevailing at that time will be charged for the full term of the contract. The Member agrees to pay the cost of all letters, telephone calls and tracing fees from being in arrears and, should the balance of the total sum be handed over for collection, to pay all legal charges as between attorney, collection agent and client together with collection commission. EFT administrators reserve the right to debit the payer/member’s account for any unpaid amount and fees, at any time of the month. 

  1. Termination or Extension of Membership 

5.1 On the expiry of the minimum term of this agreement, the agreement shall continue on a month-to-month basis as set forth in clause 2, unless the Member directs the Club to terminate the agreement. The written notice must be given to the Club at least 20 business days prior to the next payment date. A member must give written notice of the agreement by completing the notification on official forms available at the Club. The cancellation notice may also be e-mailed to info@reboothealthandfitness.com

5.2 Where the member cancels the agreement prior to the expiration of the minimum term, stipulated in clause 2, the member shall give written notice to the Club at least 20 business days prior to the intended date of cancellation. The Member shall be liable for a 10% (ten percent) cancellation fee. The cancellation penalty shall be calculated on the balance of the agreement up to the date of cancellation. For example, where a member signs a 12 month contract and cancels in the third month, the penalty shall be 10% of the total value of the contract the annual levy (that is, the Rand value of the remaining 9 months x 10% the annual maintenance levy). The Member shall then be liable and undertakes to pay all monthly membership fees, discounts (see discount table on agreement) and any other concessions granted to the Member that remain due and payable at the date of cancellation. The aforementioned amounts must be paid within 20 business days from the date of cancellation. 

5.3 All discounts shall be granted to the Member provided this contract endures for the full duration as determined in clause 2 hereto. Where the Member terminates the agreement prior to the expiration of the minimum term, any discounts given to the Member shall immediately become due and payable. 

5.5 The member is responsible to verify that no further deductions from his/her account after the approved cancellation months. No refunds will be done longer than 3 months after the approved cancellation months. 

5.6 Extensions: for a valid reason with documentation (medical/business) may be extended for a minimum of 1 month and a maximum of 6 months within an annual cycle. School holidays/holidays are not deemed as a valid reason for extension. A levy 0f 20% to the value of the monthly rate will be due for approved extended months. 

  1. Exclusion of Liability and Indemnity 

6.1 The Club shall not be responsible or held liable for any loss, damage or injury including consequential losses, suffered by or caused to any person or property anywhere on or about the Club’s property or premises, whether or not such loss, damage or injury is occasioned by any act or omission of the Club, or anyone else for whose actions the Club would be liable in law, or by reason of theft or burglary with or without forcible entry, or by reason of any condition on or off the grounds of the Club, or any defective facilities of the Club, or caused by any sporting activity carried out on the Club’s premises, or by any other causes of whatsoever nature and howsoever arising. 

6.2 The Member has advised the Club that he is medically and physically fit to use an exercise program and Club facilities and that he has consulted a physician who has 2 / 6 approved his usage of the facilities of the Club and any sporting activity offered by the Club. 

  1. Entire Agreement and Variations 

7.1 This agreement constitutes the whole agreement between the member and The Club and supersedes all prior verbal or written agreements or understandings or representations by or between the parties regarding the subject matter of this agreement, and the parties will not be entitled to reply, in any dispute regarding this agreement, on any terms, conditions or representations not expressly contained in this agreement. No variation of or addition to this agreement will be of force or effect unless reduced to writing and signed by or on behalf of the parties.

7.2 The member warrant the information given by them regarding the membership / EFT is true and correct in every respect, and undertake to notify The Club in writing by registered post of any material change in my circumstances. The member choose my above address, contact numbers or e-mail address as disclosed herein as my domiciliumcitandi et executandi for all purposes arising of this agreement. Any legal process ensuing from this agreement shall be served on the Member’s domiciliumcitandi et executandi (physical address). It is acknowledged that The Club and or third parties for marketing purposes and the like may use personal details given herein. 

  1. Member Access : This gym membership agreement entitles the member to access to The Club facilities so long as all dues are current. Access to The Club will be granted to you once your Club Membership has been approved by The Club committee. 

8.1. You will not be entitled to gain entry to The Club without your Gym membership chip.

8.2. Your Club Membership is personal to you and is not transferable. You are therefore not permitted to lend your access card to anyone else. If you allow your access card to be used by a non-Club Gym member, your Club Membership may be terminated. Hours and specific location access are as follows: Peak Times: 05:00-20:00 OFF Peak Times: 08:00-16:00 Personal & Group Training Personal training and fitness classes are offered by the gym, but are not included in the member’s membership dues. The Club reserves the right to demand additional fees for any personal or group training that the Member chooses to participate in. Swimming Pool, Sauna, studios (excluding class times) and all other training areas are open to members to use for training purposes. 

9.The Member hereby agrees to abide by all posted safety guidelines and regulations while using The Club facilities and equipment. Additionally, the Member agrees to dress and conduct them in a manner deemed appropriate for a fitness facility. The Member shall not consume drugs, alcohol, or tobacco products on The Club’s property. The Member agrees not to photograph or videotape on The Club property. The Club reserves the right to revoke the Member’s access if these terms are violated. Zero Tolerance for STEROIDS AND USE OF ANY Banned substances. The Club Management reserve the right to use a Member’s photographic images, for marketing purposes within The Club, if same is taken during photographic shoots of facilities at the Gym. 

  1. EFT Administrators is a separate registered entity and is authorised on behalf of the Club to act as funds administrator and collection agent 
  1. Group Class Rules: 6 Hours cancellation policy applies for a booked class. Late cancellation will result in a missed class 
  1. No Personal Training allowed if you are not a certified Trainer paying Rent at The Club. 
  1. Covid protocols apply to all members, no mask no entry, social distancing applies. You will not be allowed to enter the premises without a mask and following all guidelines set out by the government. 
  1. USE OF EQUIPMENT: 

14.1 Always use the equipment for the intended purpose. If you are unsure about the purpose of any equipment, you must request instruction or assistance from the Gym Management/Instructors 3 / 6 

14.2 Always replace all weights and equipment after use. 

14.3 Adhere to time limits as specified on specific equipment. 

14.4 No food, drinks (other than water bottles) or bags are allowed on the training floor or on the equipment. 

14.5 Use a sweat towel at all times whilst exercising, and wipe down the equipment you have used, immediately after use. 

  1. Respect all other members and staff by cleaning after yourself and putting away all weights and equipment that’s been used. 
  1. Zero Tolerance for racism in all forms. 
  1. REFUNDS: Fees paid are not refundable or transferrable to a third party. 
  1. Any unauthorized selling of any products or services to The Club members is strictly prohibited. Firearms or other weapons are not permitted in the Gym. 
  1. Any belongings left unattended will be available at lost property for 2 days. If you do not collect them within this time, we will donate them to charity. Any hygienic items such as towels, underwear and water bottles will be removed and discarded immediately. 
  1. AGE RESTRICTIONS: . Strictly no persons under the age of 6 are permitted to train in The Club. No Persons under the age of 16 are permitted to train without Parent or Trainer supervision. 
  1. CONDUCT: 

21.1 This is a Community Gym where we share our space with varies sports teams, squads and Group Personal Trainers. Our aim is to always have a fun and unique vibe. 

21.2 You will conduct yourself in a well-mannered fashion when in the Gym, and in a manner that will not disturb the use and enjoyment of the Gym by any other member. You may not use foul, loud or abusive language, nor may you molest or in any way harass other members. 

21.3 If you wilfully or negligently cause damage to equipment or property in the Gym, you will be held liable for the damaged caused. 

21.4 The Gym is a non-smoking facility and smoking is strictly prohibited in all areas of the Gym.

21.5 Only one individual is permitted to shower in a single shower cubicle at any one time. 

21.6 You must be dressed in suitable and appropriate, lightweight, clean exercise clothing whilst exercising in the Gym. You may not exercise without wearing a shirt or vest. 

21.7 Closed training shoes shall be worn at all times while exercising. Wearing the wrong kind of shoes is one of the most common causes of exercise injuries. The shoes you wear when you work-out should fit well, have good support and padding, and be appropriate for your selected activity. 

  1. SAFETY: 

22.1 You must read the health and safety notices attached to any equipment, and comply with their instructions and/or recommendations. If you are unsure about the working of any equipment you must ask the Gym Management or Instructors for assistance. 

22.2 You must inspect the equipment before use. Do not use the equipment if it appears to be damaged. Report any damaged equipment to the Gym Management or Instructors. 

22.3 Only get on or off equipment whilst it is stationary. Ensure that the belt on a treadmill has come to a complete stop before stepping onto or off a treadmill. Never jump off while the treadmill belt is 4 / 6 still moving. 

22.4 Keep your body and clothing free and clear from any moving parts. When using strength equipment, be certain that the weight pin is completely inserted/tightened in or around (as may be applicable) the weight bar. Never pin a weight stack in an elevated position. Never use equipment if it is found in an elevated position. 

22.5 Inspect all cables, straps and other connections. Do not use the equipment if any component appears to be missing, worn and/or damaged. Improper use of equipment could cause severe bodily harm to you or others. 

22.6 Do not run in the Gym area except in areas designated for running – such as on the treadmills or sprint lanes. 

22.7 Be aware of different floor surfaces that you move across as you walk through the Gym. Due to the nature of the Gym environment, on-going cleaning and maintenance will be taking place. Related tools and equipment may be hazardous, and some floor surfaces may be wet and therefore slippery. Proceed with caution in these areas. 

22.8 Abide by all safety signage displayed in different areas in the Gym – such signage is there for your safety! 

22.9 Report all injuries / incidents which may occur while you are in the Gym to the Gym Management or Instructors. 

22.10 Should an emergency situation arise in the Gym, you must adhere to the Gym’s Management/Instructors instructions at all times. Your cooperation during an emergency situation is necessary for your personal safety as well as that of your fellow gym members. 

  1. HEALTH: 

23.1 Each member is required to complete a Physical Activity Readiness Questionnaire (PARQ) before starting an exercise program. Where relevant medical clearance will be required before access to the gym is granted. 

23.2 Your doctor or relevant medical/health professional should do a physical examination on you before you start a new fitness programme or resume a fitness programme after a long lay-off. This is in order to determine whether you have any health risks. He or she can also give you information on how to exercise safely. It is your responsibility to ensure that you are sufficiently healthy to begin or continue with any fitness programme. 

23.3 Never wear rubber or plastic suits as these could cause your body to overheat and dehydrate. 

23.4 If you are returning to regular exercise, it is important to start slowly in order to avoid any physical injury. 

23.5 Ensure that you drink enough water and stay hydrated. If you do not drink enough water and stay hydrated, your muscle strength and endurance will be negatively affected. 

23.6 Ensure that you understand and follow the correct technique when exercising. Using any incorrect technique can lead to serious injuries. If in doubt, request the assistance of the Gym Management or Instructors. 

23.7 Spend time warming up your muscles before any type of exercise. If you do not warm up you risk damaging your muscles or straining your heart. 

23.8 Do not exert yourself for at least 2 hours after eating a big meal. 

23.9 Stop exercising immediately if you experience any of the following: 

23.9.1 Acute or chronic pain; 

23.9.2 Dizziness; 

23.9.3 Sudden heartache; 

23.9.4 Swelling of the face, hands or feet; 5 / 6 

23.9.5 Chest pain; As you could hurt yourself or cause yourself physical harm if you ignore the pain/symptom. 

23.10 Your health status will, in the discretion of the Gym Management or at your request, be assessed via blood pressure, BMI and body fat tests. 

23.11 If you are identified, medically, as a high risk individual The Club and/or the Gym Management reserve/s the right to stop you from training in the Gym facility until a medical clearance certificate has been obtained, by you, from a registered Medical Practitioner, confirming that you are sufficiently healthy to continue/resume any fitness regime.
